JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 08-07-2019 Heard Sri Rajeev Ranjan, Advocate leaned counsel for the petitioner, Sri Mithilesh Kumar, Advocate, leaned counsel appearing on behalf of the informant and learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Karamchat P.S. Case No. 68 of 2018, registered under Sections 467 and 409/34 of the Indian Penal Code, pending in the court of the Addl. Chief Judicial Magistrate-VII, Kaimur at Bhabua.

The accusation is that informant being the ward commissioner issued cheque of Rs. 85,000/- in the name of petitioner to supply the materials for construction of lane and drainage in between the house of Lalan Ram to graveyard under ward No.3 of village-Dhabpokhar, but petitioner made

Patna High Court CR. MISC. No.68693 of 2018(9) dt.08-07-2019 2/2 manipulation in the cheque by putting one zero and withdrew Rs. 8,50,000/-. Further allegation is that petitioner also withdrew Rs. 6,45,000/- by putting fake signature of the informant.

Learned counsel appearing on behalf of the informant submits that on 17.12.2018, petitioner was directed to deposit Rs. 14,95,000/- in the bank account from which the cheque was issued till 06.03.2019 subject to the result of the criminal case, accordingly, order was passed, but petitioner has not deposit the said amount till date.

Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, his prayer for grant of anticipatory bail stands rejected.
