Learned counsel appearing on behalf of the Board submits that Board has verified the record and found the certificate of this petitioner genuine.
In view of the aforesaid, the court is constrained to allow the writ application as petitioner cannot condemned on the ground that certificate is forged without enquiry. The Board itself admits that the certificate is genuine. Accordingly, the order contained in Annexure-11 cannot sustain. The order contained in Annexure-11 is hereby quashed. The respondents are directed to reinstate the petitioner
Patna High Court CWJC No.2670 of 2012(10) dt.02-07-2018 2/2 with 50 per cent back wages up to the date of superannuation and work out the entitlement of the pensionary benefits. Final decision in this regard, must be taken in the light of verification as to the genuineness of the certificate issued by the Bihar School Examination Board within a maximum period of three months from the date of receipt/production of a copy of this order.
With the aforesaid, the writ application stands disposed of.
