====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 22-05-2019 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner apprehends his arrest in connection with Barauni P.S. Case No.283 of 2018 registered under Sections 341, 323, 354, 379 and 504/34 of the Indian Penal Code.
The accusation is that on 03.07.2018, wall being was erected on the land of the informant, due to that reason, this petitioner started to abuse to the informant. When the informant made protest, then the petitioner started to cause assault to her through lathi, due to which she sustained blood oozing injury on her nose, ear and head. When the informant started weeping, then the wife of this petitioner came and started to cause assault
Patna High Court CR. MISC. No.71576 of 2018(3) dt.22-05-2019 2/2 to her through fists and slaps. At that time, the petitioner dashed the informant on the ground by catching her hair, due to which she became unconscious and when she regain consciousness, she found that her gold chain was missing.
Learned counsel for the petitioner submits that the injury sustained by the informant is simple in nature and the petitioner has no criminal antecedent.
Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai, in connection with Barauni P.S. Case No.283 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C.
