05-03-2019 Heard Sri Shiv Prasad Gupta, learned counsel for the petitioner and Sri Shyam Kumar Singh, learned Addl. Public Prosecutor.

At the very outset, learned counsel for the petitioner requested that by mistake, the petitioner failed to appear before the Mediator and as such, he requests for granting further adjournment so that he may take step for settling the dispute. In this case, on 13-12-2018, while directing for issuance of notice to opposite party no. 2, it was directed not to take any coercive step. Thereafter, on 06-02-2019, considering the nature of dispute, the matter was referred to Mediation & Conciliation Centre, Patna High Court. The report of Mediator

Patna High Court CR. MISC. No.65756 of 2018(4) dt.05-03-2019 2/2 has been brought on record, vide flag ' B', which indicates that mediation failed, since on two dates, the petitioner did not appear. It appears that since there was already interim order, the petitioner intentionally avoided to appear before the Mediator. Accordingly, there is no reason to extend the privilege of anticipatory bail.

Dismissed.
