The petitioner apprehends her arrest in connection with Rahui (Wena) P.S. Case No.208 of 2018 registered under Sections 341, 323, 498(A), 328 and 304(B)/34 of the Indian Penal Code.

The accusation is of killing the deceased, the daughter of the informant, by her husband and other in-laws for nonfulfillment of the dowry demand. Learned counsel for the petitioner submits that, in fact, the deceased, the daughter of the informant, died due to illness in course of treatment but with an ulterior motive the informant has lodged the present case. Patna High Court CR. MISC. No.69565 of 2018(6) dt.18-06-2019 2/2 in-law of the deceased and Lallu Yadav, the husband of the deceased, is already in custody. Moreover, after coming to know about the real fact, the informant has filed an application before the court of the Chief Judicial Magistrate, Biharsharif, Nalanda, to the effect that his daughter died due to illness in course of treatment but due to misunderstanding he has lodged the present case.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of her arrest or surrender by her within six weeks from today, be enlarged on bail on her furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nalanda at Biharsharif, in connection with Rahui (Wena) P.S. Case No.208 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C.
