JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-08-2019 This application has been filed for modification of the order dated 10.4.2019 passed in Cr.Misc.No. 71569 of 2018 by which petitioner was granted anticipatory bail on surrender within a period of six weeks on the basis of agreement reached between the parties.

Submission of learned counsel for the petitioner is that as wife of petitioner was suffering from illness he could not appear in court and as such he seeks two weeks further time to surrender.

Heard learned APP also.

In the above facts and circumstances, petitioner is directed to surrender on 29.8.2019 along with his wife before

Patna High Court CR. MISC. No.50623 of 2019(2) dt.14-08-2019 2/2 the court below and before accepting bail bonds of the petitioner the court below shall inquire from his wife about the marital relationship between the parties as it is submitted by learned counsel for opposite party No.2 that she is residing with the petitioner. Once the court is satisfied with the same, the bail bonds of the petitioner shall be accepted in terms of the earlier order of this Court.

With the above observation, this application is allowed.
