The petitioners apprehend their arrest in Gaunaha P.S. Case No. 17 of 2017 registered for the offences punishable under Sections 363, 366(A), 506 and 34 of the Indian Penal Code. The father of the victim made allegation against the petitioners and others that they kidnapped his minor daughter for the purpose of marriage with Bhutti Manjhi.

Learned counsel for the petitioners submits that the victim made her statement under Section 164 of the Code of Criminal Procedure and she disclosed that she, herself, left her

Patna High Court Cr.Misc. No.34722 of 2017 (2) dt.11-08-2017 house and went to the house of Bhutti Manjhi on account of some quarrel between the family members. The victim did not name the petitioner.

Considering the facts aforesaid, the petitioners above named in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Bettiah, West Champaran in Gaunaha P.S. Case No. 17 of 2017, Subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
