JUSTICE BIRENDRA KUMAR ORAL ORDER 19-09-2017 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. The petitioners are apprehending their arrest in a case registered for the offences punishable under Section 420, 467, 468, 469, 470, 471, 403, 120(B)/34 of the Indian Penal Code.

The complaint based FIR reveals that there is property dispute. Complaint is that some of the petitioners have created false sale deed in the name of the

Patna High Court Cr.Misc. No.44525 of 2017 (2) dt.19-09-2017 other co-accused with regard to the land of the complainant. Both sides are agnates.

Let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000 (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-cum-Sub Judge, 4th, Muzaffarpur/successor Court in connection with Aurai P.S.Case No.72 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioners shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
