The learned counsel for the petitioner is directed to make necessary corrections in the bail petition. Heard the learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends his arrest for the offences alleged under Section 135 Electricity Act, registered in connection with Buniyadganj P.S.Case No. 199 of 2020. As per allegation, the petitioner was running his flour mill by pilfering electricity, causing loss of Rs. 3,10,095/- to the Electricity Department.

The learned counsel for the petitioner has submitted that he is ready to deposit the loss sustained by the Electricity Department.

Considering the above facts and circumstances, let

No.58025 of 2021(2) dt.04-07-2022 2/2 the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Court of Special Judge (Electricity) Magadh Area, Gaya in connection with Buniyadganj P.S.Case No. 199 of 2020, subject to the conditions as laid down under Section 438(2) Cr. P.C. with further condition that the petitioner shall deposit the entire amount mentioned in the FIR in eight equal monthly instalements. At the time of surrender, the petitioner shall also submit the receipt showing deposit of first instalment of the amount in question. The bail shall be confirmed by the court below after deposit of last instalment. Office shall ensure that all defects are removed by the petitioners within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
