2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 323, 498(A) of the Indian Penal Code and he is husband of the complainant.
3. The matter had been sent to the Patna High Court Mediation Centre for an amicable settlement and it appears from the Memorandum of Agreement dated 04.04.2025 passed in Mediation Proceeding No. 244 of 2025 that the issues between the parties have been resolved and they are staying together as
Patna High Court CR. MISC. No.50437 of 2024(8) dt.16-07-2025 2/2 husband and wife and leading a peaceful conjugal life. It is informed that the children, however, due to their education, are staying along with their maternal grandparents, but once their session is completed, they would also be brought into the same household.
4. Considering the said agreement between the parties and the resolution of disputes between them, let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned lower Court where the case is pending/successor Court in connection with Patna City Complaint Case No. 366 of 2023, subject to the condition as laid down under Section 438
(2) of the Cr.P.C/ 482 (2) of the BNSS, 2023.
5. However, it is expected that both the parties would strictly adhere to the terms and conditions as agreed between them.
