The petitioner seeks pre-arrest bail in connection with G.O. Case No. 433 of 2019 arising out of Baheri P.S. Case No. 84 of 2019 for the offence alleged under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
The accusation is of recovery of 118 cartons, having pouches of 375 ml of Indian made foreign liquor in it and 99 cartons recovered from the van, which was being driven by Anil Kumar on which Manjit Kumar was also sitting. On query, both disclosed about supplying the same at the house of Ram Pravesh. When the informant reached at the house of Ram Pravesh, then, Ram Pravesh and Ram Lala Mandal (petitioner) were not found there.
The submission of the learned counsel for the
Patna High Court CR. MISC. No.45385 of 2019(2) dt.23-07-2019 2/2 petitioner is that being the brother of Ram Pravesh, petitioner has falsely been implicated in this case.
Learned Additional Public Prosecutor for the State opposes the prayer for pre-arrest bail.
Having regard to the facts and circumstances of the case, let the petitioner, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with G.O. Case No. 433 of 2019 arising out of Baheri P.S. Case No. 84 of 2019 shall be released on pre-arrest bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Additional District Judge II-cum-Special Judge, Excise, Darbhanga, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
