The petitioner seeks bail in Koran Sarai P. S. Case No. 34 of 2019 instituted for the offence under Section(s) 379, 411, 413, and 414/34 of the Indian Penal Code. It is submitted by petitioner's counsel that petitioner has been arrested merely on the basis of disclosure made by two other persons, namely, Santosh Kumar and Ritesh Kumar when they were apprehended with the stolen motorcycle. The motorcycle which is said to have been recovered from the petitioner's possession bearing Registration No. BR 44E- 8094

Patna High Court CR. MISC. No.46331 of 2019(3) dt.27-09-2019 2/3 is registered in petitioner's name and photo copy of the Registration Certificate is annexed as Annexure-2 to bail petition and this fact has been taken note of by the Court below while rejecting the petitioner's application for bail. In the instant case petitioner is in custody since 19.04.2019.

Learned A.P.P. for the State opposed the prayer for bail.

Having considered the rival submissions of the parties, prayer for bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate-1st Class, Buxar, in connection with Koransarai P.S. Case No. 34 of 2019, subject to the following conditions:-

(1) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(2) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his
