====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER --------- 11-08-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Bahadurganj P.S. Case No.48 of 2017 registered under Sections 363, 366 and 302/34 of the Indian Penal Code.

The accusation is that while Rajela Begum, the daughter of the informant Rehana Khatun, had gone to the clinic of Dr. Sabnam Yasmin for treatment alongwith her maternal aunt, in the way, she was enticed away by Ajay Kumar (petitioner no.1). When the informant came to know this fact then she asked the other petitioners to call her

Patna High Court Cr.Misc. No.34743 of 2017 (2) dt.11-08-2017 2/2 daughter, who promised her to call her daughter. On 22.02.2017, when the informant asked them about her daughter, they refused to call her daughter and gave threatening.

Learned counsel appearing on behalf of the petitioners submits that the allegation of enticing away the daughter of the informant is against the petitioner no.1 Ajay Kumar and other petitioners are his family members. Further submission is that the victim, the daughter of the informant, was examined under Section 164 of the Code of Criminal Procedure in which she has not whispered about having the hands of any of the petitioners in her kidnapping. The petitioners have no criminal antecedents.

Having considered the facts and the circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender by them within six weeks from today, be enlarged on bail on their furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Kishanganj, in connection with Bahadurganj P.S. Case No.48 of 2017, subject to the conditions laid down under Section 438(2) Cr.P.C.
