2. The petitioner seeks regular bail in connection with S. Tr. No. 799 of 2024, 177 of 2024 arising out of Tekari P.S. Case No. 203 of 2021, lodged on 05.05.2021 under Sections 304(B), 201 & 34 of the Indian Penal Code.

3. Learned counsel for the petitioner submits that the bail application of the petitioner has earlier been rejected vide order dated 14.03.2024 passed in Cr. Misc. No. 17596 of 2024 with a liberty to renew his prayer for bail nine months after framing of charge.

4. Counsel further submits that the petitioner is the husband and he has been in custody since 13.07.2023. Counsel further submits that the marriage was solemnized seven years ago from the date of alleged occurrence and the same has been acknowledged in the order passed by the co-ordinate Bench of this Hon'ble Court at the time of granting bail to the other coaccused vide order dated 10.01.2024 passed in Cr. Misc. No.

Patna High Court CR. MISC. No.52416 of 2025(3) dt.26-09-2025 2/2 83770 of 2023. Counsel also submits that the criminal antecedent of the petitioner is clean.

5. Learned APP for the State opposes the prayer for bail and submits that on the previous occasion, a report regarding present stage of the trial was called for. From the said report, it transpires to this Court that the charge has been framed on 07.10.2024 and not a single witness has come forward.

In the present facts and circumstances of the present case, particularly considering the observations made by the co-ordinate Bench of this Hon'ble Court that the marriage was solemnized seven years ago from the date of occurrence and the criminal antecedent of the petitioner, let the petitioner above named, be granted bail, on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) as mentioned in Section 2(1) (d) of the BNSS, 2023 to the satisfaction of A.D.J.-XIX, Gaya, in connection with S. Tr. No. 799 of 2024, 177 of 2024 arising out of Tekari P.S. Case No. 203 of 2021, subject to the following conditions as laid down under Section 480(3) of the BNSS.
