The petitioner seeks bail in Bairiya P.S. Case No. 313 of 2020, registered for the offence under Section 363, 366(A) of the Indian Penal Code and Section 12 of the POCSO Act. As per the prosecution case, this petitioner alongwith other co-accused persons kidnapped the minor daughter of the informant.
It is submitted on behalf of petitioner that the victim in her statement recorded under Section 164 Cr.P.C. has stated that after being admonished by her parents, she with her consent went with this petitioner and no one had kidnapped her and she had also solemnized marriage with the petitioner. The victim girl has stated her age, as 18 years. Petitioner has got clean
Patna High Court CR. MISC. No.57483 of 2021(2) dt.01-02-2022 2/2 antecedent and he is in custody since 15.01.2021. Learned A.P.P. for the State has opposed the bail petition.
In view of statement of the victim girl recorded under Section 164 Cr.P.C., the bail petition of petitioner is allowed. Let the above-named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. 7th cum Special Judge (POCSO), West Champaran at Bettiah in connection with Bairiya P.S.
