JUSTICE ARVIND SRIVASTAVA ORAL ORDER 24-11-2017 Heard learned counsels for the petitioners and the State. Petitioners apprehend arrest in connection with Barari (Semapur) P.S. Case No. 172 of 2017 registered for the offence punishable under sections 302, 120B/34 of the Indian Penal Code and section 27 of the Arms Act.
Learned counsel appearing for the petitioners submits that petitioners have been implicated in this case due to previous enmity. Petitioners were not connected with the business activities of the deceased. Similarly situated co-accused has been granted bail by this Court vide order dated 09.11.2017 passed in Cr. Misc. No. 49532 of 2017.
Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the
Patna High Court Cr.Misc. No.49061 of 2017(3) dt.24-11-2017 2/2 petitioners, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, V, Katihar in connection with Barari (Semapur) P.S. Case No. 172 of 2017 subject to the conditions laid down under section 438(2) Cr.P.C.
