The petitioner is apprehending his arrest in a case in connection with Gopalpur P.S. Case No. 319 of 2022 registered for the offences punishable under Section 30(a) of the Bihar Prohibition & Excise Act.

There is recovery of 20 litres of country made Liquor from the house of the petitioner.

Learned counsel for the petitioner submitted that the petitioner has falsely been implicated in this case and nothing has been recovered from the conscious possession of the petitioner.

Learned A.P.P appearing on behalf of the State has

Patna High Court CR. MISC. No.47287 of 2022(2) dt.11-11-2022 2/2 vehemently opposed the prayer of the petitioner and submitted that the recovery of illicit liquor has been made from the house of the petitioner.

Considering the fact that the place of recovery belongs to petitioner, this Court is not inclined to grant privilege of anticipatory bail to the petitioner. The prayer for grant of anticipatory bail to the petitioner stands rejected.
