JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-07-2019 This application, for grant of anticipatory bail, arises out of Tr. No. 1267/2018 (Complaint Case No. 1261/15), disclosing offences under Section 420 of the Indian Penal Code. Allegation as per complaint petition is that on 11.09.2018, the petitioner approached the complainant and his cousin to open an account in Perles Agrotek Corporation Limited and to deposit Rs. 4560/- every six months till six and half years and, thereafter, they shall be paid Rs. 49,200/- and they have opened the account, however, later on the company was closed and they fled away. Submission of learned counsel for the petitioner is that a proceeding is going on in Hon'ble Supreme Court, however, in spite of that, petitioner is ready to return the amount to the complainant, if some time is allowed.

Having heard both sides, considering the facts and circumstances of the case and also the submission of learned counsel for the petitioner, let petitioner, above named, surrender in the court below within a period of two weeks along with a bank draft of Rs. 9200/- drawn in favour of the complainant, on which, the court below shall enlarge the petitioner on provisional bail for a period of five months on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) with two sureties of the like amount each to his own satisfaction, during which period, the petitioner shall pay the remaining amount of Rs. 40,000/- in five equal installments of Rs. 8,000/- and once the full amount is being deposited, the court below shall confirm the provisional bail of the petitioner. It is made clear failure to pay any of the installments shall make the petitioner liable for cancellation of his bail bonds. The above amount so deposited by the petitioner shall be released in favour of the complainant.
With the above observation and direction, this application is disposed of.
