Mr.Shyam Kumar Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 28-09-2022 Learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month.

Heard the learned counsel for the petitioner as well as the learned APP for the State.

Learned counsel for the petitioner has submitted that the petitioner was granted regular bail provisionally for a period of three months, vide order dated 02.07.2020 passed in Cr.Misc. No. 20428 of 2020. As the Covid-19 pandemic was prevailing at the time of passing of the said order, it was directed by this Court that in view of Covid-19 pandemic, it will be open for the learned court below to accept the bail bond on furnishing an undertaking by the surety, on photo copy of his Aadhar Card to the effect that he is ready to become the bailor of the petitioner which may be transmitted by such surety to the learned court concerned through e-Mode.

It was further observed that the provisional bail of the petitioner will be confirmed by the learned court below within three months on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Patna City,

Patna High Court CR. MISC. No.47640 of 2022(2) dt.28-09-2022 2/2 Patna in connection with Khajekalan P.S.Case Non 493 of 2019, including one surety given at the time of provisional bail. It was also observed that the learned court below will be at liberty to further extend the period of provisional bail if the court proceeding in physical mode will not resume in next three months.

In view of aforesaid, three months' time, as observed in the said order shall be reckoned from today. With this observation, the application stands disposed of.

Office shall ensure that all the defects are removed by the petitioner within the stipulated time provided hereinabove, failing which the matter shall be brought to the notice of this Court.
