2. The petitioner seeks bail in connection with Cyber P.S. Case No. 20 of 2025 instituted for the offences punishable under Sections 303 (2), 318 (4), 319 (2) and 336 (3) of the BNS.

3. Allegation against the petitioner is to have committed fraud through mobile phone.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence and has falsely been implicated in this case merely on the basis of mere suspicion. He submits that there is no cogent and legal evidence against the petitioner. He further submits that petitioner is not named in the FIR and his name has been surfaced in this case only on the basis of confessional statement of co-accused. Petitioner is in custody since 20.02.2025.

5. Learned APP opposes the prayer for bail.

From perusal of the FIR and impugned order of the learned District and Additional Sessions Judge-Vth, Nawada dated 30.05.2025, it appear that the name of the petitioner has been surfaced in this case only on the basis of confessional statement of co-accused Yashpal Sharma, who has already been granted bail by a Co-ordinate Bench of this Court in Cr. Misc. No. 44272 of 2025 vide order dated 28.07.2025. Similarly situated co-accused person namely Ankit Raj @ Ankit Kumar, has already been granted bail by a Co-Bench of this Court in Cr. Misc. No. 44535 of 2025 vide order dated 28.07.2025, so considering all these aspects of the matter, I am inclined to grant bail to the petitioner.

7. Accordingly, the prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-1st, Class, Nawada in connection with Cyber P.S. Case No. 20 of 2025.
