====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 28-01-2019 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is apprehending her arrest in a case for the offence registered under Sections 409, 419 and 420 of the IPC.

The prosecution story, in brief, is that this petitioner Taregna Devi and her husband has defalcated the government money which is in respect of regulation of the Anganbari in connivance with each other.

It has been submitted by learned counsel for the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner has been made accused in the present case due to mistake of fact. The petitioner is a lady.

Patna High Court Cr.Misc. No.70160 of 2018(3) dt.28-01-2019 2/2 She is alleged to have working as 'Aaganbari Sevika' on the name of one Taregana Devi. The petitioner claims herself to be Taregana Devi and she is not Lalsa Devi. Other co-accused has been granted anticipatory bail by another Co-ordinate Bench of this Court vide Cr. Misc. No. 69572 of 2018 order dated 17.12.2018.

On behalf of the learned counsel for the State, it has been submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioner above named, in the event of arrest or surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Sasaram, Rohtas, in connection with Nokha P.S. Case No. 184 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
