JUSTICE ANIL KUMAR SINHA ORAL ORDER 22-03-2023 Petitioner renews his prayer for regular bail in connection with Sessions Trial No. 437 of 2021 (arising out of Muffasil P.S. Case No. 601 of 2020 (G.R. No. 4022 of 2020) registered for the offence under Section 341, 323, 307, 302, 447, 387, 324, 504, 506 & 34 of the I.P.C. inasmuch as earlier bail application of the petitioner was rejected vide order dated 07.12.2021 passed in Cr. Misc. No. 28226 of 2021 on the ground that bail application of similarly situated co-accused namely, Deepak Choudhary was rejected by a Co-ordinate Bench of this Court in Cr. Misc. No. 26923 of 2021. The said similarly situated co-accused Deepak Choudhary again moved before this Court for grant of bail in Cr. Misc. No. 52420 of
Patna High Court CR. MISC. No.47300 of 2022(6) dt.22-03-2023 2/2 2022 which also got dismissed vide order dated 04.01.2023. Taking into consideration the fact that bail application of similarly situated co-accused has been dismissed by a Co-ordinate Bench of this Court in 2nd attempt taken by him, accordingly, I am not inclined to grant regular bail to the petitioner inasmuch as bail application of the petitioner was rejected earlier on the ground of parity.
The prayer for bail is rejected.
However, the trial court is directed to conclude the trial preferably within a period of one year as observed by the Co-ordinate Bench in its order aforesaid dated 04.01.2023 passed in Cr. Misc. No. 52420 of 2022.
