1. Heard learned counsel for the petitioner and learned counsel for the State.

2. The petitioner apprehends his arrest in connection with Mahila P.S. Case No. 18 of 2023 registered under Sections 376, 379, 420, 504, 506, 509/34 of the Indian Penal Code and Section 67(A) of the I.T. Act.

3. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Further submission is that the first information report has been lodged after a delay of 3 years of the incidence. The petitioner has got no criminal antecedent.

4. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in

No.51885 of 2023(3) dt.30-08-2023 2/2 the event of arrest or surrender before the learned court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of Sub-Divisional Judicial Magistrate, Samastipur in connection with Mahila P.S. Case No. 18 of 2023, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
