In this application for anticipatory bail the petitioners apprehend their arrest in connection with Ballia P.S. Case No. 107 of 2017 for the offences punishable under sections 147, 148, 149, 447, 323, 325, 337, 338, 379, 307, 504, 506 and 302 of the I.P.C. The learned counsel for the petitioners submits that in the First Information Report there is no specific allegation against petitioner nos. 1 and 2. So far petitioner no.3 is concerned, the only allegation against him is that he came later on at the place of occurrence with pistol and caused threats to kill all the family members if the case will be lodged. The allegations are omnibus
Patna High Court Cr.Misc. No.44445 of 2017 (2) dt.22-09-2017 2/2 and general in nature against petitioner nos. 1 and 2 and as such they deserve sympathetic consideration.
The learned A.P.P. opposes prayer for pre-arrest bail of the petitioners by submitting that during treatment injured Gulab Singh died.
In the facts and circumstances stated above, the petitioners, in case of their arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of C.J.M, Begusarai in connection with the aforementioned case, subject to the condition as laid down under section 438 (2) of the Cr.P.C.
