The petitioner apprehends his arrest in connection with Complaint Case No. (C) 10 of 2018 registered under Sections 323 and 498A/34 of the Indian Penal Code. The accusation is of torturing the complainantopposite party no. 2 by her husband and in-laws due to nonfulfillment of demand of dowry and also removing from her matrimonial house snatching her personal belongings. Learned counsel for the petitioner submits that, in fact, petitioner is the husband of the complainant and he is ready

No.68449 of 2018(8) dt.21-06-2019 2/2 to keep his wife-opposite party no. 2 with full dignity and honour but his wife-opposite party no. 2 is not ready to live with the petitioner. Further submission is that while the notice has been issued to the complainant-opposite party no. 2 but she refused to take the aforesaid notice.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., East Champaran, Motihari, in connection with Complaint Case No. (C) 10 of 2018, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
