2. Petitioner apprehends arrest in a case registered for the offence punishable under section 379 of the Indian Penal Code.

3. The informant suspects that the truck parked at the police station was taken away by the petitioner. The truck was loaded with sand, which was seized in Sonepur P.S. Case No. 260 of 2021 due to the transportation of sand without a challan, which caused a loss to government revenue.

4. It is submitted that petitioner has been made accused on suspicion because he is owner of truck. There is no eye witness to the alleged occurrence. Truck has been recovered from road side from a public place not from the possession or presence of

5. Learned counsel for the State opposes the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate , Saran , Chapra in connection with Sonepur P.S. case no. 1003 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
