The petitioner apprehends his arrest in connection with Chapra Muffasil P.S. Case No. 410 of 2016 registered under Sections 323, 341, 354, 307 and 379/34 of the I.P.C. pending in the Court of C.J.M., Chapra at Saran.

Submission is that petitioner is innocent and has falsely been implicated in this case as alleged in the F.I.R. The occurrence took place due to land dispute and both the parties are neighbour as well as pattidar.

Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner with submission that there is direct allegation of assault through iron rod against the petitioner.

Patna High Court Cr.Misc. No.44472 of 2017 (3) dt.10-11-2017 2/2 Having considered the facts and circumstances of the case and nature of the allegation, I am not inclined to allow the prayer of the petitioner for anticipatory bail. Accordingly, this application is rejected.
