The petitioners apprehend their arrest in connection with a case registered for the offences punishable under Sections 147/149/140/323/341/342/307/364 of the Indian Penal Code and Section 27 of the Arms Act.
Learned counsel for the petitioners submits that the entire First Information Report is vague and mischievous and the petitioners are merely pattidar who have been cultivating the land on sharehold basis. There is no dispute, but out of pure mischief, they have been named in the present First Information Report. The land, in fact, belongs to the Thakurbari which is being
Patna High Court Cr.Misc. No.35654 of 2017 (2) dt.11-08-2017 P2/2 cultivated by the present petitioners at the instance of the trustee and since there is a dispute with regard to the Thakurbari, the petitioners, being the agents of the said trustee, are being implicated in connection with the present case. Having heard learned counsel for the petitioners and learned counsel for the State and there being no cogent material in the present case, let the petitioners above named, in the event of their arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Barh, Patna, in connection with Ghoswari P.S. Case No. 08/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
