JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 01-07-2019 Heard learned counsel for the petitioners and the learned A.P.P. for the State as also the learned counsel for the informant. The petitioners apprehend their arrest in connection with Simri P.S. Case No.39 of 2016 registered under Sections 406, 420 and 504/34 of the Indian Penal Code.

Learned counsel for the petitioners submits that, earlier, the matter was referred before the Patna High Court Mediation Centre, Patna, for settlement of the dispute in between the petitioners and the informant, where both parties agreed to settle their dispute of land on measurement by the Government Amin. Thereafter, the husband of the informant came at his village from abroad and also put his signature on the Punchnama prepared after Panchayat in

Patna High Court CR. MISC. No.70290 of 2018(3) dt.01-07-2019 2/2 which it was decided that 16 Dhurs land, which is in possession of the petitioners, will be transferred by the husband of the informant through sale deed on taking the consideration amount of Rs.2,00,000/-.

On the other hand, learned counsel for the informant has not disputed the aforesaid submissions as advanced by the learned counsel for the petitioners but submits that uptil now, the land has not been transferred.

Having considered the facts and the circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender by them within six weeks from today, be enlarged on bail on their furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Sri Shailendra Kumar, Judicial Magistrate, First Class, Darbhanga, in connection with Simri P.S.Case No.39 of 2016, subject to the conditions laid down under Section 438(2) Cr.P.C.
