JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 08-12-2022 At the outset, learned counsel for the petitioners seeks permission to withdraw this application so far as petitioner no. 2 Santosh Singh is concerned.

Permission is accorded. It may be done in course of the day.

The petitioners (i.e. petitioner no. 1 & 3) apprehend their arrest in a case registered for the offence under Section 307 & other allied sections of the Indian Penal Code and Sections 25(1-B)a, 26, 27 and 35 of the Arms Act.

It is submitted on behalf of petitioners that due to land dispute between the parties, an occurrence of simple Maarpit

Patna High Court CR. MISC. No.47134 of 2022(2) dt.08-12-2022 2/2 took place, in which, both sides sustained injury. There is case and counter case. The injury sustained by the injured is simple in nature. It is further submitted that during pendency of this petition, good sense prevailed between the parties and matter has been compromised between them. Similarly situated coaccused Harihar Singh has already been granted anticipatory bail by this Court, vide order dated 25.07.2022 passed in Cr.Misc. No. 2091 of 2022. The petitioners have got clean antecedent.

Considering the same, let the above named petitioner no. 1 and 3, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bailbonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Sasaram (Rohtas) in connection with Sasaram (Mufassil) P.S. Case No. 288 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) anay/- U T
