The petitioners have preferred this application for grant of regular bail in a case registered under section 120B of the Indian Penal Code and section 30(a) and 41(1) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, 4432.5 litres of liquor was recovered from the truck.

It is submitted by learned counsel for the petitioners that the petitioners have been falsely implicated in the case. They have no concern either with the seized liquor or with the vehicle from which it was allegedly seized. They are in custody

Patna High Court CR. MISC. No.57184 of 2021(3) dt.27-04-2022 2/2 since 07.07.2021 and have no criminal antecedent. Chargesheet has been submitted in the case. Heard learned APP for the State.

Having heard learned counsel for the parities and taking into consideration the petitioners not having any criminal antecedent and having remained in custody for nine months, the petitioners, above-named, are directed to be released on bail in connection with Begusarai Muffassil P.S. Case No. 359 of 2021 on their furnishing bail-bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cumSpecial Judge, Excise Act, Begusarai.
