2. The petitioner is seeking regular bail in connection with Banmankhi P.S. Case No. 116 of 2024 for the offences punishable under Sections 341, 323, 376, 504, 506 of the Indian Penal code.

3. As per allegation, the accused persons including the petitioner entered into the house of the informant and committed rape upon her. On protest, the accused persons including the petitioner had threatened the informant's sister-inlaw to kill her and also to assault her.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. He has further submitted that both the alleged victim

Patna High Court CR. MISC. No.50155 of 2024(2) dt.12-08-2024 2/2 and the petitioner are adult. They have solemnized marriage and they are residing together as husband and wife. The informant has filed an application in the Court of ACJM-Ist in which she has stated that she was leading happy conjugal life with the petitioner. He has also submitted that the petitioner is a person of clean antecedent and is under custody since 09.05.2024.

5. On the other hand, the learned APP for the State has opposed the prayer for bail.

6. Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand rupees) with two sureties of the like amount each to the satisfaction of learned ACJM-Ist, Purnea in connection with Banmankhi P.S. Case No. 116 of 2024, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
