1. Heard learned counsel for the petitioner, Mr. Naresh Dikshit and learned APP for the State, Mr. Chandra Bhushan Prasad.

2. The petitioner seeks bail in a case registered for the offences punishable under Sections 302, 120B and 34 of the Indian Penal Code and Section 27 of the Arms Act.

The learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that on 23.06.2024, her husband was watering flowers at the door, when two accused came on a motorcycle and fired indiscriminately killing her husband. It is next alleged that her husband used to carry work of buying and selling property with Shishir Kumar and other named accused persons

Patna High Court CR. MISC. No.52471 of 2025(3) dt.17-10-2025 2/3 and on account of old dispute relating to land, her husband has been killed. It is next alleged that on 08.03..2023, on the day of Holi, Shishir and other assaulted her husband and got him arrested.

4. The learned counsel for the petitioner submits that petitioner is not named in the FIR. It is further submitted that Shishir Kumar had approached this Court seeking anticipatory bail by filing Cr. Misc. No.60773 of 2024 and the same was allowed by an order dated 01.10.2024. It is next submitted that while granting the privilege of anticipatory bail to Shishir Kumar, this Court had considered the case in detail and on merits. It is further submitted that Kharbar Gope @ Yogendra Kumar and Divya Sundar @ Divyam, who are also named in the FIR had approached this Court seeking regular bail by filing Cr. Misc. No.75735 of 2024 and Cr. Misc. No.4903 of 2025 respectively and the same was allowed by an order dated 25.10.2024 and 14.02.2025 respectively. The learned counsel appearing on behalf of the petitioner submits that name of the petitioner transpired during the course of investigation in the confessional statement of co-accused. It is further submitted petitioner is in custody since 20.11.2024. It is also submitted that petitioner will not abscond rather will cooperate in the trial

5. Learned A.P.P. Sri Chandra Bhushan Prasad opposes the bail application.

6. Considering the submission made by the learned counsel appearing on behalf of the petitioner, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-VIth, Patna City, Patna in connection with Alamganj P. S. Case No. 511 of 2024.

7. The application stands allowed.

8. However, it is made clear that in the event, if the learned trail Court comes to a conclusion that after his release, petitioner is trying to delay the framing of charge or after framing of charge is delaying the trial, in both the conditions the learned trial Court shall be at liberty to cancel the bail bonds of the petitioner.
