The petitioner apprehends his arrest in connection with Marhowrah P.S. Case No. 155 of 2017, registered under Sections 395 and 397 of the Indian Penal Code, pending in the court of the learned Addl. Chief Judicial Magistrate-XIII, Saran at Chapra.
Learned counsel for the petitioner submits that it would appear from the F.I.R. that petitioner is not named in the F.I.R. and the name of the petitioner has been surfaced in the confessional statement of Pappu Manjhi. Further submission is that, in fact, on the date of occurrence, the petitioner was in Gujrat and he was under treatment on the date of occurrence. On perusal of the record, it appears that informant
Patna High Court Cr.Misc. No.71759 of 2018(3) dt.04-02-2019 2/2 has detailed physique of several culprits involved in the dacoity.
Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, his prayer for grant of anticipatory bail stands rejected. The petitioner is directed to surrender before the trial Court within four weeks and pray for regular bail, which would be considered by the trial Court in accordance with law without being prejudiced by the order of this Court.
