2. The present petition has been preferred for the following relief(s):

"for issuance of an appropriate Writ(s)/Rule(s)/Direction(s) in the nature of mandamus commanding the respondent concerned for payment of price of 29 decimal of land, as per prevailing Market value alongwith the amount of Solatium and statutory interest, to the petitioner, because the petitioner's 29 decimal Raiyati land situated under Khata no. 104, Khesra No. 1469,

Patna High Court CWJC No.1846 of 2015(3) dt.01-07-2025 2/3 Mauza-Naraura has been acquired by the respondents for construction of canal under Koshi Nahar Yojna, and against the acquisition of 29 decimal land, only Rs. 1,65,082.00 (Rupees one Lac Sixty five thousand eighty two only) at the rate of Rs. 5692.48 (Rupees five thousand Six hundred Ninety two and forty eight paise only) per decimal has been given to petitioner on 3.10.2012, which is much less than the Market value of the land, because the market value of the land is Rs. 40137.61 (Rupees Forty thousand one hundred thirty Seven and Sixty one paise only) per decimal."

After some arguments, learned counsel for the petitioner submits that he will be satisfied if the matter is taken up by the Arbitrator-cum-Commissioner, Darbhanga Division, Darbhanga as his grievance is that the petitioner has been discriminated vis a vis other land holders who have been granted compensation.

4. Granting said liberty to approach the Arbitratorcum-Commissioner, Darbhanga Division, Darbhanga, the writ petition stands disposed of.

5. It is expected that if the petition is preferred in next four weeks, the same shall be taken up to its logical conclusion.
