2. The petitioner seeks regular bail in connection with Sessions Trial No.313 of 2024 arising out of Patepur P.S. Case No. 298 of 2023 lodged on 04.12.2023, for the offence punishable under Sections 304(B), 120(B) & 34 of the Indian Penal Code.

3. Learned counsel for the petitioner submits that the bail application of the petitioner was earlier rejected vide order dated 20.07.2024 passed in Cr. Misc. No. 44573 of 2024 with a direction to the trial court to expedite the trial. Counsel submits that the petitioner is in custody since 05.12.2023, having clean

Counsel submits that the death of petitioner's wife took place at her home (mayka) and petitioner's father in law had called him and when the petitioner reached there, then he was sent into custody. Counsel submits that on earlier occasion, report regarding the present stage of the trial has been called for from which it transpires that charge-sheet has been submitted, cognizance taken, charge has also been framed and only one prosecution witness has been examined.

4. Learned APP for the State opposes the prayer for bail of the petitioner and submits that the present case pertains to section 304(B) of the Indian Penal Code.

5. Upon perusal of the record, it transpires to this Court that the death of petitioner's wife has been caused at her home (mayka) and the petitioner is in custody since 2023, charge has been framed on 23.07.2024 and one prosecution witness has been examined.

6. In the present facts and circumstances of this case considering that no purpose would be solved keeping the petitioner into custody, let the above named petitioner be granted bail on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) as mentioned in Section 2(1)(d) of the B.N.S.S., 2023 to the satisfaction of Additional Sessions Judge-
