The petitioner seeks bail in a case registered under Sections 25(1)(b)(a)/26(ii)/35 of the Arms Act and Sections 37(b)(c) of Bihar Prohibition & Excise Act, 2016. Allegation is that one country made pistol along with five live cartridges are recovered.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 12.03.2018. Charge sheet has been submitted in the case. There is no allegation of tampering of witnesses alleged against the petitioner. Petitioner has falsely been implicated in the present case. One country made pistol along with five live cartridges are said to have been recovered. There is no compliance of Section 100 of Cr.P.C.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge-cum-Special Judge, Excise Act, Madhubani in connection with Benipatti P.S. case No.35 of 2018.
