JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 22-08-2022 Heard learned counsel for the petitioners and learned APP for the State and perused the case diary. The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 379/34 of the Indian Penal Code and Section 56 of the Bihar Minor Mineral Concession Rules, 2019.

It is a case of loss of revenue of the Government of Bihar due to illegal mining and sell of sand by the Mafia of the State of Bihar.

It is submitted by learned counsel for the petitioners that the petitioners have falsely been implicated in this case due

He further submits that the case has been lodged against the petitioners on the application of Sanjay Kumar Yadav but Sanjay Kumar Yadav has already denied that he had given any such information and has also filed an affidavit in the court below to that effect vide Annexure-2. Petitioners have clean antecedent.

Learned APP appearing for the State opposed the anticipatory bail.

Considering the aforesaid submissions, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Araria in connection with Raniganj P.S. Case No. 55 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
