2. The petitioner seeks bail in a case registered for the offence punishable under Section-447, 307 of the Indian Penal Code and Section-27 of the Arms Act.

3. It is alleged that in the backdrop of petty feud, an altercation took place between the parties and in consequence thereof, the petitioner is said to have fired, which hit the at the knee of the informant.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and he has falsely been implicated in this case. It has further been submitted that he has got two criminal cases against him but one is under bailable section

Patna High Court CR. MISC. No.50295 of 2024(3) dt.26-10-2024 2/2 whereas the second relates to the present case for recovery of the arms. It has further been submitted that except these cases, there is no other case against the petitioner.

5. On the otherhand, learned counsel for the informant has vehemently opposed the prayer for bail by submitting that the injured was a labourer and the petitioner has fired upon him without any rhyme and reason.

6. Considering the aforesaid facts and circumstances, specially the period of incarceration which is about six months, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur (Bhabua) in connection with Bhabua (Sonhan) P.S. Case No. 341 of 2024 with condition that the petitioner will appear in the court physically on each and every date till framing of charge.
