The petitioner apprehends his arrest in Arrah Muffasil P.S. Case No.119 of 2019 registered under Sections 272 and 273 of the Indian Penal Code and under section 30(a) of the Bihar Prohibition and Excise Act.
The informant got secret inputs that petitioner had brought and kept huge quantity of liquor by the side of the river and the informant went to the other side of the river and saw a person fleeing away. On search, huge quantity of 8 PM whisky was recovered.
Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. The recovery was made from the bank of the river.
Having considered the facts that the recovery was

No.43869 of 2019(2) dt.17-07-2019 2/2 made from the bank of the river and the petitioner has no criminal antecedent, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 4th Additional Sessions Judge-cum-Special Judge, Excise Act, Bhojpur at Arrah in connection with Arrah Muffasil P.S.
