Petitioner seeks bail in a case registered for the offences punishable under Sections 120(B),121,121(A),122 of the Indian Penal Code read with Sections 17,18,18b,20,23UA (p)Act, 1967 and 25(1B),26 and 35 of the Arms Act. Later on Section 67 of the I.T. Act was added.

Submission is that no firearm or any other incriminating article was recovered from possession of the petitioner. Petitioner has got no criminal antecedent. He is named only for the reason that co-accused disclosed that he had purchased one of the firearms from the petitioner. Considering the fact that there is lack of sufficient material against the petitioner for refusal of prayer for

Patna High Court CR. MISC. No.47157 of 2019(2) dt.30-07-2019 2/2 bail, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Civil Lines Police Station Case No.60 of 2018, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
