1. Heard learned counsel for the parties.
2. The petitioners have renewed their prayer for grant of regular bail in connection with Dumariya P.S. Case no. 14 of 2014 registered under sections 147, 148, 149, 435, 436 and 120B of the Indian Penal Code, sections 3 and 4 of the Explosive Substance Act and section 17 of the C.L.A. Act.
3. As per the prosecution case, it is stated that in the night the extremists belonging to MCC carried out a bomb blast destroying the tower of Airtel company. It is stated that on enquiry from the local population, the names of 50 persons including the petitioner herein transpired as belonging to the MCC besides 50 unknown.
4. Learned senior counsel appearing for the petitioners
Patna High Court CR. MISC. No.46653 of 2025(2) dt.11-07-2025 2/3 submits that the earlier application for bail of the petitioners was rejected vide order dated 28.10.2024 passed in Cr. Misc. no.68079 of 2024 giving liberty to the petitioner to renew their prayer for bail after completing one year in custody or after framing of charge, whichever is later. It is submitted that the petitioners have remained in custody for more than 1 year and referring to the order brought on record as Annexure-P/5 to this petition it is submitted that charge has been framed against both the petitioners on 11.3.2025. The petitioners are in custody since 29.5.2024 and 27.6.2024 respectively and undertake to cooperate in the trial.
5. The application for bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the allegations against the petitioners in the F.I.R., the observations given in the aforesaid order of rejection dated 28.10.2024, the petitioners having remained in custody for more than a year since 29.5.2024 and 27.6.2024 respectively and charge having been framed against the petitioners in the learned trial Court on 11.3.2025, both the petitioners are directed to be enlarged on bail in connection with Dumariya P.S. Case no. 14 of 2014, on each of them furnishing
Patna High Court CR. MISC. No.46653 of 2025(2) dt.11-07-2025 3/3 bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Sherghati, Gaya. (Partha Sarthy, J) avinash/- U T
