The appellant is apprehending his arrest in connection with Madhepura Mahila P.S.Case no.45 of 2018 registered for offences punishable under Sections 376, 506, 34 of the Indian Penal Code and Sections 3(i)(w) of SC/ST (Prevention of Atrocities) Act.

Allegation against the appellant is of committing rape upon the informant.

Submission of the learned counsel for the appellant is that there is inordinate delay in loding the FIR and that has not been explained.

Heard learned Spl.P.P. also.

Having heard both sides and in view of the facts and

APP (SJ) No.4392 of 2018(3) dt.16-01-2019 2/2 circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the appellant, however, the appellant is directed to surrender before the learned special Judge within a period of six weeks from the date of order and make prayer for regular bail, which will be considered by the learned court below without being prejudiced by the order of this Court.
