2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 302, 201, 120B and 34 of the Indian Penal Code.

3. As per the prosecution case, informant's brother got information through mobile phone that dead body of his uncle was lying near Madaipur(Baheri). Thereafter, informant reached on the spot and found that dead bodies of his brother and his 3rd wife Sharda Devi were lying near MadaripurFatehpur Road. Informant suspects that his uncle and his wife have been killed by some unknown persons.

4. It is submitted on behalf of the petitioner that this petitioner is innocent and has falsely been implicated in this case. Deceased had three wives. During investigation, it has

Patna High Court CR. MISC. No.48401 of 2025(3) dt.03-11-2025 2/2 come that co-accused Rakesh Kumar @ Bittu Kumar, son from 2nd wife of deceased, had a property dispute with his father. Petitioner's name has come in this case during course of investigation on the basis of confessional statement of coaccused Nitish Kumar. Said Nitish Kumar has already been acquitted by the trial court in Sessions Trial No. 587/2024.

5. Learned counsel for the State opposes the prayer for pre-arrest bail.

6. Considering the aforesaid facts of the case, prayer for bail of this petitioner is allowed. In the event of arrest/surrender within eight weeks from today, let this petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate 1st class, Danapur Patna in Khirimore Police Station Case No. 182 of 2023, subject to the conditions laid down under section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023.
