Petitioner is an accused in connection with Banka (Barahat) P.S. Case No. 248 of 2019 for the offence registered under Sections 314, 323, 307 of the Indian Penal Code read with section 34 of the said code and Section 3⁄4 of the Explosive Substance Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 15.07.2019. Earlier prayer for bail of the petitioner was rejected vide order dated 20.12.2019 passed in Cr. Misc. No. 84784 of 2019 with an observation that the petitioner may renew his prayer for bail after framing of charge.

Patna High Court CR. MISC. No.5087 of 2021(4) dt.17-03-2021 2/2 Learned counsel for the State opposes the prayer for bail and submits that earlier this application was rejected with an observation that the petitioner mkay renew his prayer for bail after framing of charge but the petitioner has come to this court before framing of charge. As such, the same may be rejected. Considering the above facts and circumstances of the case and also the fact that this application is at the stage of premature, I am not inclined to grant bail to the petitioner. It is, accordingly, rejected.
