The petitioner apprehends his arrest in connection with Begusarai Town P.S. Case No.166 of 2021, registered for the offences punishable under Sections 25(1-b)a/26/35 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. It is also submitted that the petitioner has got no criminal antecedent as stated in paragraph-3 of the bail application. It is further submitted that name of the petitioner surfaced in the case in the confessional statement of a coaccused. The police has recovered the motorcycle from the house of co-accused, Chanchal Kumar.

Learned APP for the State opposed the prayer for

Patna High Court CR. MISC. No.57182 of 2021(3) dt.13-10-2022 2/2 anticipatory bail of the petitioner.

Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
