The petitioner is apprehending his arrest in connection with Bidupur P.S.Case No.56/2018 registered for offences punishable under Sections 147, 148, 149, 341, 447, 323, 324, 307, 379, 504 and 506 of the Indian Penal Code. Allegation against the petitioner that is of assault by the sharp edged weapon to the informant that hit on his eye. Submission of the learned counsel for the petitioner is that thee is dispute with respect to construction of safety tank and the injuries are found to be simple in nature. Heard learned A.P.P. and the laerned counsel for the informant. They have drawn my attention towards the impugned order whereby in the Sessions Judge has mentioned that the injured informant is present before the court and from the open

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant anticipatory bail to the petitioner, rather let the petitioner is directed to surrender before the learned court below within a period of six weeks from the date of order and make prayer for regular bail, which will be considered by the learned court below on the basis of materials available on the record. With the aforesaid observation, this application is dismissed.
