2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 392, 395, 412, 120(B), 201 and Indian Penal Code and Section 27 of the Arms Act.
3. The case of the prosecution is that the informant Parasmal Soni was having a jewellery shop. On 22.06.2022 informant along with his son went to Sealdah. After purchasing jewellery of worth rupees one crore forty two lakh thirty four thousand six hundred sixty four he was returning by train. All jewellery were kept in a bag. When train reached Kadagola railway station, three unknown persons entered in the coach,

In the meantime, an unknown person vacuumed the train then three persons came near informant and threw chili powder on his face and all three unknown miscreants snatched his bag of jewellery and left the train. Informant also came out of train and he saw that they are running towards south side. When the informant raised alarm, one person fired on the coach but somehow informant narrowly saved his life.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. In this case, the name of this petitioner has surfaced on the basis of confessional statement of of co-accused Md. Babar. It is further submitted that from perusal of the FIR, it transpires that there is allegation that there were three persons who threw chili powder and three unknown persons snatched his bag but in this case, altogether twenty accused persons have been framed by the I.O. Learned counsel for the petitioner has also submitted that nineteen accused persons have been granted bail in this case in which some of the co-accused persons have already been granted bail by co-ordinate Benches of this Court vide Annexure-4 series to this petition. TI parade has not been conducted and nothing has been recovered from the conscious possession of the petitioner. . Moreover, he is

5. Learned APP appearing for the state has opposed the prayer of regular bail and submitted that petitioner has seven criminal antecedents.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail with a condition that Petitioner shall co-operate in the trial and shall be present on each and every fixed date and on his absence on two consecutive dates without sufficient reason, his bail bond shall be cancelled by the Court below. The above named petitioner is directed to be released on bail in connection with Naugachiya Rail P.S. Case No. 20 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Khagaria.
