The petitioner applied against an advertisement in the year 2016 for being considered for appointment on the post of Anganwari Sevika against the vacant post of EBC category. The aforesaid selection process could not be comcluded and the vacancies remained unfulfilled. Thereafter, again in the year 2017, an advertisement was issued against which the petitioner again applied but that process also could not be taken to its logical conclusion. In

Patna High Court CWJC No.13669 of 2019(2) dt.15-07-2019 2/3 the meantime, certain corrections / rectifications also were made with respect to the reservation for different categories on the asking of the petitioner and other desirous candidates. However, till date the process has not been concluded.

The petitioner represented before the District Magistrate, Banka for redressal of her grievance but till date the process of selection remains inconclusive. This depicts a sorry state of affairs.

The petitioner, under the aforesaid circumstances, is directed to make a fresh representation before the District Programme Officer, Banka, intimating the details of the number of times that the advertisement was issued but the process could not be completed and that the process has not yet been concluded and seats have remained vacant. On such representation, if filed by the petitioner within a period of two weeks, the District Programme Officer, Banka shall look into the matter and pass a reasoned order in accordance with law, within a further period of six weeks thereafter for ensuring that the process of selection is completed as

If the order is not passed by the District Programme Officer, Banka or the petitioner remains aggrieved with the order passed by him, she would have an option of appealing before the District Magistrate, Banka. In case the District Programme Officer, Banka does not pass an order within the time-line prescribed by this Court, the District Magistrate shall look into the matter and if it is found that it is only for the lackadaisical approach of the District Programme Officer, Banka, that the orders of this Court has not been complied with, necessary action be taken against him in that regard.

With the aforesaid observation / direction, this petition stands disposed off.
