2. The present writ petition has been preferred for the following relief(s):
(i) That the present Writ Petition is being filed for issuance of an appropriate Writ / Order / Direction for quashing the Notice dated 01.04.2025 in Jamabandi Cancellation Case No.08/2019 against the Petitioner.
It is relevant here to mention that the above said notices have been issued in gross violation of the Section 9 of the Bihar Land Mutation Act, 2011, whereby and
Patna High Court CWJC No.11068 of 2025(2) dt.15-07-2025 2/3 whereunder no reason has been assigned by the Additional Collector, Sasaram for issuing the said notice.
(ii) Further, the present Writ Petition is being filed for issuance of an appropriate Writ / Order / Direction for staying the further proceeding of the Jamabandi Cancellation Case No. 08/2019 pending before the Additional Collector, Rohtas, Sasaram.
(iii) That the present application is filed seeking any other relief(s) as deemed fit by this Hon'ble Court in the interest of justice and equity.
3. After some argument, learned counsel for the petitioner submits that he shall be filing reply to the notice.
4. The submission is that in CWJC No. 10508 of 2025 (Dinesh Tiwari & Ors. Vs. State of Bihar), on 07.07.2025, the same stance was taken by the petitioner.
5. A notice has been issued, the same should be replied with supportive documents so that the matter is taken to its logical conclusion. Unfortunately, the writ petition(s) is/are being filed.
6. However, taking the same line as ordered in the case of Dinesh Tiwari (supra), the petitioner is allowed to appear and submit reply along with all the necessary documents
Patna High Court CWJC No.11068 of 2025(2) dt.15-07-2025 3/3 to satisfy the bona fide.
7. In case, the same is presented, the authority is dutybound to take the matter to its logical conclusion at an earliest after hearing the parties.
8. The writ petition is disposed of with aforesaid observation.
